General Terms and Conditions of INASKA GmbH

1. Scope of Application

The following General Terms and Conditions (GTC) apply to all business relationships in the INASKA online store between INASKA GmbH and a customer in the version valid at the time of the order.

2. Contracting Parties & Conclusion of Contract

The presentation of our goods in the INASKA online store does not constitute a legally binding offer on our part, but is merely a non-binding invitation to the customer to purchase goods. By ordering the selected goods, the customer submits a binding offer to conclude a purchase agreement.

The ordering process in the INASKA online store consists of the following steps:

1) Selection of the desired item(s). 2) Confirm by clicking the "Add to Cart" button.

3) Click the "View Cart" button.

4) Review the items in your shopping cart.

5) Click the "Proceed to Checkout" button.

6) Log in to the online store after registering and entering your login details (email address and password) or order as a guest.

7) Review and, if necessary, correct the entered information.

8) Submit your order by clicking the "Place Order" button.

We will immediately confirm receipt of your order by sending you an automatically generated email ("Order Confirmation"). With this email, we accept your offer, and the purchase agreement is concluded.

We store the contract text from orders in our online store and send you the order details and our Terms and Conditions by email. The Terms and Conditions can also be viewed at any time at https://www.inaska.com/agb.
... For deliveries to Switzerland, the purchase agreement is concluded between the buyer and MeinEinkauf AG, St. Gallen (CHE-331.561.017 VAT). MeinEinkauf AG also handles customs clearance, invoicing, and delivery within Switzerland. This service is included in the purchase price and any applicable shipping costs. To ensure smooth delivery to Switzerland, we would like to inform you, for transparency, that MeinEinkauf GmbH in Konstanz, Germany (DE285677365) is also part of the supply chain. This does not incur any additional costs for the buyer.

3. Prices, Payment, Shipping Costs

The prices listed in our online store include statutory VAT and all other price components. Shipping costs, if any, will be added and will be clearly indicated to you before you complete your purchase.

You can pay via PayPal, instant bank transfer, or credit card (VISA, Mastercard). No additional fees will apply to any of the payment methods. The INASKA online store always uses SSL encryption during the payment process. To use PayPal, you must be registered with PayPal or register before completing your order, log in with your credentials, and confirm the payment instruction to us. Further information on processing payments via the various methods is available during the checkout process. Your credit card will be charged upon completion of your order.

Unless otherwise clearly stated in the product description, all items we offer are ready for immediate shipment. Shipping within Germany is free for orders over €80.00; otherwise, shipping costs are €4.90. For international shipping, we charge €12.90 within the EU, €15.90 outside the EU (Switzerland), and €28.90 for third countries (USA). You will be notified separately of the shipping costs for your order in the INASKA online store before completing your payment.

The shipping costs for your order will be displayed separately before you complete your purchase in the INASKA online store. Every INASKA bikini is lovingly hand-packed and will reach you within 3-5 business days in Germany, 3-8 business days within the EU, and 10-20 business days for international shipping outside the EU after we receive your order.

You have a 30-day return policy from the date you receive your delivery.

All our prices include VAT. No customs duties apply within the EU. For orders from outside the EU, taxes, customs duties, or other fees levied by the destination country (import fees) may apply.

4. Right of Withdrawal

As a consumer, you have the statutory right of withdrawal as described in the cancellation policy, which we voluntarily extend to 30 days. During the 14-day statutory withdrawal period, the legal provisions apply. Further details can be found under the section "Cancellation Policy."

5. Damage in Transit

If goods are delivered to you with obvious damage in transit, please report such damage to the delivery person as soon as possible and contact us immediately. Failure to report damage or contact us will not affect your statutory rights and their enforcement, in particular your warranty rights. However, your cooperation helps us to assert our own claims against the carrier or transport insurance company.

6. Warranty, Guarantee, Liability

Unless expressly agreed otherwise, the statutory warranty rights for defects apply.

In cases of slight negligence, we are otherwise only liable for breaches of essential contractual obligations (cardinal obligations) and only up to the amount of foreseeable damage. This limitation does not apply to injury to life, body, or health, or where liability is mandatory under the Product Liability Act. Otherwise, claims for damages against us are excluded. Regardless of fault, our liability remains unaffected in cases of fraudulent concealment of a defect or the assumption of a guarantee.

We are also liable for any impossibility of delivery that occurs by chance during our delay, unless the damage would have occurred even with timely delivery.

The foregoing provisions also apply to the benefit of our legal representatives and agents if claims are asserted directly against them.

7. Retention of Title

We retain title to the goods until full payment of the purchase price.

8. Copyright

The content and structure of the INASKA online store are subject to copyright, trademark law, design law/registered design law, and other intellectual property laws. Unless otherwise stated, all trademarks in the INASKA online store (in particular, the brand name and logo) are protected by trademark law.

9. Final Provisions

If you are a business, German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

If you are a merchant as defined by the German Commercial Code (HGB), a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from contractual relationships between us and you is our registered office.

German and English are available as contract languages for both consumers and businesses.
